POLITICAL CONSTITUTION

Article 203.-The Accounts Tribunal shall be divided into two (2) courts; the first shall have exclusive authority in suits under administrative law and the second, in the control of the expenditure accounts of the General Budget of the Nation. It shall lay an annual report before the Executive Power and before the House of Deputies on the implementation of the said Budget.

NOTE: The Political Constitution of Paraguay does not envisage an Office of the Financial Comptroller of the Nation.

  

  

LAW ESTABLISHING THE AUTHORITY OF THE OFFICE OF THE FINANCIAL COMPTROLLER OF THE NATION

Decree Law No. 16

Article 1.- The Office of the Financial Comptroller of the Nation shall depend on the President of the Republic and shall be responsible for maintaining a control over all state allocations of the Central Administration and Decentralised Entities that collect or spent public funds, through financial and administrative audits and the evaluation of internal control systems, either directly or through professionals or specialised firms.

It shall take decisions on public and competitive bidding and prepare the annual report on the financial administration of the Central and Decentralised Administration to be presented to the National Congress.

Article 2.- The Office of the Financial Comptroller of the Nation shall submit its reports and its opinions, along with the audit results, to the President of the Republic and to the authority in charge of the audited entity.

Article 3.- The Office of the Financial Comptroller of the Nation shall be responsible for establishing and regulating the organisation and functioning of the internal audits of all the state expenditures, framing the regulations and procedures and then controlling the administration of these audits, in accordance with the laws in force on the matter.

Article 4.- The Financial Comptroller shall be appointed by the President of the Republic, at the proposal of the Technical Secretariat for Economic and Social Development Planning in the Office of the President of the Republic.

Article 5.- The Executive Power is hereby empowered to frame the rules for this Decree Law in order to set up the Office of the Financial Comptroller according to its needs and authority, in accordance with the relevant legal provisions.

Article 6.- The Honourable National Congress is hereby informed.
